Dear Delegate Hammen:
HB504 would clarify that an unlawful employment practice is established when a specified classification is a motivating factor for any employment practice, even though other factors also motivated the practice; and provide that a specified Supreme Court ruling is not to be applied in any cases brought under provisions of law prohibiting discrimination in employment.
The Legislative Committee of the Carroll County Chamber of Commerce opposes this bill. This bill would address issues that are already adequately covered under Title VII and Maryland Fair Employment Practices. Furthermore, this bill would establish that an unlawful employment practice is established when it may be demonstrated that race, color, religion, sex, age, national origin, marital status, sexual orientation, genetic information, or disability was a motivating factor for an employment practice, even though other completely valid factors were involved in the employment decision.
We therefore ask that your committee give this bill a negative report.
